The present document (General Terms and Conditions of Sale) defines the conditions applicable to sales concluded between, on the one hand, persons wishing to make a purchase via the website hCOSMETICARYttps://www.COSMETICARY.com, hereinafter referred to as "the customer" and, on the other hand, the company COSMETICARYwhose registered office is located Rue A. Orts 11B. 1000 Brussels, of which intra-Community VAT number is BE0871818578hereinafter referred to as "COSMETICARY.com". These terms and conditions apply exclusively to natural persons who are not traders.

PRICE

All prices of products are quoted in euros all taxes included except participation in shipping costs (see paragraph Shipping and Delivery). COSMETICARY.com reserves the right to change prices at any time without notice. The products will be invoiced on the basis of the rates in force at the time of order registration. The products remain the property of COSMETICARY.com until the complete collection of the price by COSMETICARY.com. The price is payable in full and in a single payment.

ORDERS

The customer can order on the Internet via the site www.COSMETICARY.com. COSMETICARY.com reserves the right to cancel or refuse any order from a customer with whom there is a dispute over payment of a previous order or which presents any form of risk in his eyes. Any order implies acceptance of the prices and description of products available for sale. COSMETICARY.com undertakes to fulfill orders received on the website only within the limits of available stocks of products. In the absence of availability of one or more products ordered, COSMETICARY.com undertakes to inform the customer as soon as possible. The customer's order will then be automatically cancelled and the corresponding amount refunded.

SHIPMENTS AND DELIVERIES

Delivery by BPost

Delivery costs:

  • For Belgium: € 5,25 (free for purchases over € 60)
  • For the Netherlands and Luxembourg: € 6,95
  • For Germany and France: € 7,95
  • For the rest of Europe (except DOM TOM) : € 14,95

Our shipping times are as follows:

  • For all orders placed from Monday to Friday before 1pm, the order will be shipped the same day.
  • For any order placed from Monday to Thursday after 1pm, the order will be shipped the next day.
  • For any order placed from Friday after 1pm to Sunday evening, the order will be shipped the following Monday.
  • For all orders placed on holidays, the order will be shipped the next business day.

Delivery times are 48 working hours (excluding weekends and public holidays) for Belgium and up to 30 days for the rest of Europe.

No home deliveries are made on Saturdays, Sundays and holidays.

Cosmeticary.com makes every effort to execute orders within the time limits listed above, but delays may occur due to unforeseen circumstances or the delivery area. 

If Cosmeticary.com is not able to meet the delivery deadlines for any reason whatsoever, it will inform the customer and will offer him either to continue the purchase process with a new delivery date, or to cancel the order and refund the full amount he has paid. 

PAYMENT

Payment is done by credit card or bank transfer.

RIGHT OF WITHDRAWAL 

According to the law, the customer has the right to cancel a contract concluded on the Internet or by telephone without giving a reason within 14 days after delivery of the goods. At Cosmeticary.com, every buyer is entitled to withdraw from the contract without giving a reason within 30 days after delivery of the goods. This also applies to purchases made in our physical store.

If the customer wishes to exercise this right, it is advisable to inform Cosmeticary.com of its decision to withdraw from the agreement within the aforementioned period. The best way to do this is to contact us via [email protected] or by calling +32 (2) 346 89 62. The customer can also use the withdrawal form (Download the withdrawal form)

In case of cancellation of the contract, Cosmeticary.com will refund the customer the purchase price of the goods. In case of cancellation within 14 days after delivery of the goods, the customer will also be entitled to a refund of the delivery costs in the amount of the cheapest delivery method offered. In the event of subsequent termination of the contract, Cosmeticary.com will only refund the purchase price of the goods. The above-mentioned funds will be refunded without delay, at the latest 14 days after the date of termination. However, in accordance with the law, Cosmeticary.com may defer the refund until the goods are recovered, or until the consumer has provided proof of shipment of the goods, whichever comes first. For refunds, Cosmeticary.com will use the same method of payment that the customer used to pay the purchase price.

The customer shall return the goods without delay, at the latest within 14 days after the date of withdrawal, to the address Rue Auguste Orts 11B - 1000 Brussels (Belgium). If, within the framework of the conclusion of the contract, additional goods ("gift") have been sent free of charge to the customer by the seller, it is necessary to return said gift with the goods to be returned. The customer will provide the customer with all necessary information regarding the sending of the goods via the mentioned contacts.

It should be noted that, in accordance with the law, the customer shall be liable for any reduction in the value of the goods resulting from handling the goods in a manner other than that necessary to become familiar with the nature, properties and functionality of the goods (e.g. if the customer continues to use a perfume even after having already tried it). It should also be noted that the customer is not entitled to withdraw from the contract in the case of products manufactured according to his requirements or customized products and sealed products that cannot be returned for reasons of health protection or hygiene and which have been unsealed by the consumer after delivery. 

In case of withdrawal from the contract, Cosmeticary.com will refund all payments received from the customer, including, if applicable, the shipping costs. For the refund, Cosmeticary.com will use the same means of payment that the customer used to pay the purchase price.

SECURE TRANSACTIONS

COSMETICARY.com implements all means to ensure the confidentiality and security of data transmitted on the web and on the website https://www.COSMETICARY.com. As such, the website uses a secure payment module such as SSL (Secure Socket Layer).

All the texts, comments, works, illustrations and images reproduced on COSMETICARY.com are reserved under the copyright as well as the title of the intellectual property and for the whole world. As such and in accordance with the provisions of the code of intellectual property, only the use for private use is authorized, subject to different provisions, even more restrictive code of intellectual property. Any total or partial reproduction of the COSMETICARY.com site is strictly forbidden without prior agreement.

RESPONSIBILITY

The .com company Cosmeticaryhas, for all the stages of access to the site, the process of order, delivery, customer service or subsequent services, only an obligation of means. The responsibility of Cosmeticary.com could not be engaged for all the inconveniences or damages inherent to the use of the Internet network, in particular one sold out of the service, an external intrusion or the presence of computer viruses, or of any fact qualified as force majeure, in accordance with the jurisprudence.

LEGAL GUARANTEE OF CONFORMITY OF GOODS

The legal guarantee corresponds to the guarantee on consumer goods provided by article 1649bis and following of the Civil Code also known as "guarantee of conformity" which protects the customer when the products purchased by a customer have a lack of conformity. The legal guarantee of conformity benefits all individuals residing in the European Union.

If the customer has a problem with a product sold, the customer can contact our customer service department.
The 2-year legal guarantee applies to any lack of conformity of the product that the customer has purchased, i.e. when :
- The characteristics of his purchase do not correspond to those of the model presented;
- The quality and services do not meet the customer's expectations; or
- The customer cannot use the product for its normal intended purpose or for the specific functions it had requested.

Rights provided by the legal guarantee of conformity :
If the product purchased by the customer has a defect covered by the warranty of conformity, the customer has the right to obtain, free of charge, a repair or a replacement of the product. The customer has the right to obtain a price reduction or the cancellation of the contract in the following cases:
- If repair or replacement of the product is not possible;
- If replacement or repair cannot be implemented within a reasonable time ;
- If the replacement or repair cannot be implemented without major inconvenience to the customer.
Please note that a minor defect for which repair or replacement is not possible or unreasonably expensive does not entitle the customer to rescind the contract.

Duration of the legal guarantee of conformity :
The legal guarantee of conformity covers defects in conformity that occur within two years of the delivery of the product that the customer has purchased. The customer is advised to keep the proof of purchase of the product. Defects of conformity that appear within two years from the delivery of the product are presumed to have existed at the time of delivery, except where this presumption is not compatible with the nature of the product or the nature of the defect of conformity or unless proven otherwise.

Exchange, return and reimbursement

If the goods are defective at the time of delivery, the customer shall be entitled to repair or replacement of the goods, or to reduction of the price or rescission of the contract with reimbursement - with the customer's consent, these damages may also take the form of a voucher. The customer shall also have the right to demand the elimination of the defect in the form of a replacement delivery or repair. In the event that the elimination of a defect is impossible or unreasonable for us, the customer has the right to demand a discount on the purchase price and, if the defect is substantial, he can also withdraw from the purchase contract. He also has these rights if such a defect appears later. In case of missing product in the order, it is necessary to announce to Cosmeticary.com so that we can make the delivery of the product at our expense. If the delivery of the product within an additional and reasonable time is not possible, Cosmeticary.com will refund the customer the costs according to the option chosen in the claim form. 

Cosmeticary.com shall be liable for defects in the goods if they become apparent within two years of delivery of the goods.

Goods shall be deemed to be defective, in particular if they do not have the usual or presented properties, do not serve their purpose, do not comply with legal requirements or have not been delivered in the agreed quantities. Please note that an increased sensitivity or allergic reaction to the delivered products cannot in itself be considered a defect of the products. Similarly, defects in gifts and other free services that Cosmeticary.com provides beyond the scope of the order do not constitute a defect. The images of the products in our online store are only illustrative and do not constitute a binding representation of their properties (e.g. the packaging may differ due to a change made by the manufacturer).

Customers are advised to indicate what they consider to be a defect or how the defect is manifested, as well as their complaint handling requirements.

Cosmeticary.com will inform the customer of the status of the claim, in particular its receipt, acceptance or rejection, by e-mail. Cosmeticary.com may also contact the customer by telephone.

Cosmeticary.com will make a decision on the claim without delay. The processing of the complaint, including the elimination of the defect, will not normally exceed 30 days. Otherwise, the customer has the right to withdraw from the purchase contract. It is necessary for the customer to provide Cosmeticary.com the necessary assistance to meet the above deadline.

In the event of justified complaint, Cosmeticary.com supports the expenses related to the return of the goods.

PROTECTION OF PERSONAL DATA

COSMETICARY.com reserves the right to collect data on the customer, including through the use of cookies in accordance with current legislation. The user can expressly oppose the disclosure of his details. To do so, he just has to indicate it by writing toCOSMETICARY, Customer Service, Rue A. Orts 11B 1000 Brussels. In accordance with the law of January 6, 1978, the user has a right of access and rectification of data concerning him.COSMETICARY.com uses cookies to recognize the customer when connecting to the site www.COSMETICARY.com. The customer can at any time disable the use of these cookies by selecting the appropriate settings in his browser.

NOTICE MANAGEMENT POLICY

Judge.me automatically verifies reviews based on the order history of Cosmeticary.com. If the notices are not associated with existing orders (e.g., directly from the websites Cosmeticary.com), Cosmeticary.com may request manual verification by submitting proof of orders.

A verified buyer badge is added once the review is verified by Judge.me. The badge can be translated and customized, but cannot be added by Cosmeticary.com even.

Ask for advice

Cosmeticary.com sends an email request for review to customers based on settings and conditions. Automatic reminders or web push notifications can be enabled. Cosmeticary.com may also request notification from past customers, not send automatic notification requests, or request/remind individual users. Cosmeticary.com can respond privately or publicly to any notice.

Give feedback

The customer can leave a review in the review form by e-mail or via the review widget. Product reviews are submitted via the review widget, while store reviews are submitted via the All Reviews page. Visitors can leave reviews without a (trackable) purchase history ("web reviews"). These can be disabled but will never receive a "Verified Buyer" badge if the reviewer's email is not on the store's customer list. Reviews provided by the same email will have the same display name.

Opinions are always voluntary. Cosmeticary.com does not pay their authors to write them.

The email address the customer provides will not be published and is used for verification purposes only.

Change the policy

Reviews can be edited to resolve typos, style/formatting issues, or minor review information. However, star ratings cannot be changed to maintain the integrity of reviews on Judge.me. After a change is made, an email notification is sent to the reviewer informing them of any changes. The reviewer can reject any changes by clicking in the notification email. The Judge.me team is notified of all review changes and review denials.

Method of calculating the stars

For the overall rating of the product, all the reviews given are taken into account to make the average.

Curation Review

Cosmeticary.com has full control over publishing and hiding reviews and new reviews are published automatically by default. Merchants can enable review curation to choose which reviews to publish manually.

Cosmeticary.com makes every effort to ensure that the content of reviews is helpful and honest. Reviews may be removed if they do not comply with our review policy.

Contributions must be based on real experiences and information. Intentionally false content, irrelevant content, defamatory language, personal attacks and unnecessary or incorrect content are all against our policy.

Cosmeticary.com reserves the right to deactivate contributions added by customers to avoid abuse. Cosmeticary.com also reserves the right to remove content that violates our policies.

The content that Cosmeticary.com monitors and deactivates when detected is as follows:

Dangerous or denigrating content

  • Content that threatens or incites self-harm, or threatens or incites harm to others.
  • Content that harasses, intimidates or offends an individual or group.
  • Content that incites hatred or discrimination against an individual or group, or denigrates an individual or group because of their race or ethnicity, religion, disability, age, nationality, veteran status, sexual orientation, gender, gender identity, or any other characteristic associated with systematic discrimination or marginalization.

  • The same content posted multiple times.
  • Content for the same product from multiple accounts by the same auditor.

Irrelevant content

  • Content that is not based on the appraiser's experience in purchasing a good or service from the company where the appraisal is published.
  • Content containing political or social commentary or personal rants.

Advertising

Content that contains calls to action or offers to sell products or services.

Offensive content

Involving obscene, defamatory or offensive language or gestures.

Sexually explicit content

Content containing sexually explicit material.

Identity theft

Content attributed to persons, organizations or companies that the author is not authorized to represent.

Conflict of interest

Content that is not fair or impartial, such as:

  • A review written about the author's own business.
  • A review of a current or past professional experience.
  • A dishonest review designed to influence a competitor's evaluation.

Illegal content

Illegal content or content presenting illegal activities.

Report a potentially false review

The customer can report a potentially false review by sending an email to [email protected]. Cosmeticary.com will then try to find out if the reported review is indeed a fake review and if it should be deleted. The author of any reported or suspicious review will be systematically contacted by email in order to justify his review and possibly to provide the proof of purchase. Any reported or suspicious review not justified within 72 hours will be systematically deleted.
